1. Acceptance of these Terms
These Terms of Use ("Terms") form a binding agreement between you and the developer of EyeCandy ("we," "us," "our") and govern your access to and use of the EyeCandy iOS application, the eyecandy.app website, the Candy AI assistant, and any related services (together, the "Service").
By creating an account, downloading the app, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country, whichever is higher) to create an EyeCandy account. If you are under the age of majority in your jurisdiction, you may only use the Service with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
3. Your account
You are responsible for the email and password you use to access EyeCandy. Keep them confidential. You agree to notify us immediately at eyecandyiossupport@gmail.com if you suspect any unauthorized use of your account.
You are responsible for all activity that happens under your account, including any data you import, link, or generate. You may not share your account with another person.
4. The license we grant you
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to download and use the EyeCandy app on devices that you own or control, solely for your personal, non-commercial use.
This license does not include the right to:
- Rent, sell, sublicense, or commercially exploit any part of the Service.
- Reverse engineer, decompile, or extract the source code of the app, except where this restriction is prohibited by applicable law.
- Use automated tools to scrape, copy, or republish content delivered through the Service.
- Bypass rate limits, security measures, or access controls.
- Resell or redistribute imported third-party content (such as posters, cover art, or descriptions) outside of personal use within the app.
5. User content
You retain ownership of the content you create in EyeCandy: ratings, reviews, custom collections, notes, and personal lists ("User Content"). You grant us a limited license to store, display, and sync your User Content on the devices linked to your account.
You are solely responsible for your User Content. You agree not to upload anything that is illegal, infringing, abusive, defamatory, or that you do not have the right to share. We may remove User Content that violates these Terms or applicable law.
6. Third-party content and integrations
EyeCandy displays metadata sourced from third parties (TMDB, MyAnimeList, AniList, RAWG, IGDB, Open Library, Comic Vine, ESPN, and others). We do not own this content, and its accuracy is not guaranteed. Trademarks, posters, cover art, and other artwork shown in the app belong to their respective rights holders and are displayed for product illustration and personal tracking purposes only.
If you connect a third-party account (for example, MyAnimeList, RAWG, Open Library, Apple Music, Spotify), your use of that service is governed by that provider's own terms and privacy policy. We are not responsible for the availability, content, or behavior of third-party services.
7. Candy AI
The Candy AI assistant is a feature that uses a third-party large language model (currently DeepSeek) to generate responses based on your prompts and your library context. AI responses:
- Are generated automatically and may be inaccurate, incomplete, or out of date.
- Should not be relied on for medical, legal, financial, or other professional advice.
- May reference copyrighted works for informational and recommendation purposes only.
- Are subject to fair-use limits. Excessive automated requests may be throttled or blocked.
If you provide your own DeepSeek or Google Cloud API key, requests routed through that key are governed by the relevant provider's terms.
8. Free service. Voluntary contributions.
EyeCandy is offered free of charge. There is no paid tier, no subscription, and no advertising. Some optional features (such as unlimited Candy AI usage) require you to supply your own third-party API key, which you obtain and pay for directly with that provider. We do not handle any payments.
9. Acceptable use
You agree not to use the Service to:
- Violate any law, regulation, or third-party right.
- Harass, threaten, or impersonate another person.
- Distribute malware, phishing content, or unsolicited promotional material.
- Probe, scan, or test the vulnerability of the Service without our written permission.
- Interfere with or disrupt the Service, its servers, or any user's experience.
- Submit prompts or content that exploit minors, promote violence, or incite discrimination.
We may suspend or terminate accounts that violate these rules.
10. Service availability
We work hard to keep EyeCandy reliable, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue all or part of the Service at any time, with or without notice, including features, third-party integrations, or supported platforms.
We may also push app updates that change behavior, fix bugs, or remove features. Your continued use of the Service after an update means you accept the changes.
11. Termination
You may stop using the Service and delete your account at any time from Settings → Account → Delete Account within the app. We may suspend or terminate your access to the Service if you breach these Terms, if we are required to do so by law, or if continuing to provide the Service to you would expose us or other users to risk.
On termination, your license to use the Service ends. Sections that by their nature should survive termination (intellectual property, disclaimers, indemnity, limitation of liability, governing law) will survive.
12. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that any data displayed (including content from third-party providers and AI responses) is accurate or up to date.
13. Limitation of liability
To the fullest extent permitted by law, in no event will the developer be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of the Service.
Our aggregate liability for any claim arising out of or related to these Terms or the Service is limited to one hundred US dollars (USD $100) or the amount you paid us for the Service in the twelve months preceding the claim, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.
14. Indemnification
You agree to defend, indemnify, and hold harmless the developer from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service, (b) your User Content, (c) your violation of these Terms, or (d) your violation of any law or third-party right.
15. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which the developer is based, without regard to conflict-of-laws principles. You agree that any dispute arising out of these Terms or the Service will be resolved in the competent courts of that jurisdiction, unless mandatory consumer-protection law in your country gives you the right to bring proceedings in your local courts.
16. Changes to these Terms
We may revise these Terms from time to time. When we make a material change, we will update the "Last updated" date and post the new version at this URL. If the change materially affects your rights, we will also notify you in the app or by email. If you do not agree to the revised Terms, your remedy is to stop using the Service and delete your account.
